Six Quick Points of Disguise

So, you find yourself in a place where you shouldn’t be and you need a quick escape. You’ve stayed low profile and haven’t stood out too much, but you know that if you go out the way you came it will definitely be suspicious. Whatever the case may be, a quick disguise would aid in a safe extract. Now. before we continue, let me remind you that all information can be used for good or evil so what you do with this is your decision. I accept no responsibility.
Wherever I go, I always carry a backpack with me that is equipped with a few items. These include, but are not limited to a change of clothing, sunglasses, a razor, a hat, wrist watch, notebook with pen/pencil, reading material (your favorite issue of 2600 maybe?), and a prescription or non-prescription reading classes. To disguise yourself you need to change at least six (6) features about yourself you make it effective. I will be describing myself as an example for this article just to demonstrate what I am discussing.
Before Look
Prior to going through any sort of transformation, my typical appearance would be an Asian-American computer nerd with a shaved head, contact lens’, a little facial stubble, jeans and a plain t-shirt. I have a pretty plain description and it’s not that eccentric, but this is good. Why? When you are disguising yourself, you should think of it as if you are a blank page on an easel. All additions are details that hide the white space.
The Change
If you have the option to go to the nearest restroom, by all means, take it! Here, you can take the time to start from the bottom up. If I’m wearing pants my change of clothing would usually consist of shorts. My t-shirt would be changed with a short-sleeve, button-down, and collared shirt. I would use the razor to shave what little stubble I had and replace my contacts with my glasses. Now, put on my had and the wrist watch and I am ready to go.
After Look
Now, my hat is covering my shaved head. My glasses alter the overall shape of my face; which is also a bit smoother now. My clothes
are completely changed from what I started with and the wrist watch adds a little extra detail. People in general do not have an eye for detail, which is why you need to have this skill. Take the time to analyze your features or traits and how you get these features and traits about you. Then, see how well you can change them on the fly. Can anyone say Superman (glasses vs. no glasses)?
The Next Step
Logically, the next thing you need to do is get the hell out! Pack your things nice and neat and leave immediately. It is important to note here that this is a quick disguise used for even quicker escapes. If someone stares at you long enough it can spell disaster for you. How can you make a quick escape without running or even seeming like you’re in a rush? This is where your notebook or reading material come into play. You can use your notebook and pen/pencil to walk around (in the general direction of your exit) as if you are taking notes. This may add a look of authority to you; at least enough not to be challenged about your presence so easily. The reading material can be used to make an incremental progression to the door. It may be cliche in movies, but just sitting down with your disguise and reading for a little bit can evade people who are just passing by. You don’t have to cover your face and cut out a hole to see through your material. That’s just nonsense.
Points To Consider
There are a few things you might want to do to help make your escape as easy and trouble-free as possible.
1) Try to avoid leaving the premises from the same place you entered.
2) Your disguise should match your environment. If you’re in a business environment, clothes that are business to business casual would be a wise decision.
3) Pack as light and as cheap as possible. If you have to ditch your supplies after the transformation it would be best not to carry brand name items.
4) From beginning to end, bring little to no attention to yourself.
Advanced Techniques
If you have ever taken a formal acting class, or if you think you can pull it off, you can try disguising your demeanor as well. This can be done through a slight limp or hunching while you walk, just to name an example. Whether or not you need to talk to anyone before you leave, you might want to keep the idea of changing your voice inflection in the back of your mind. Your new voice can fit your new personality if you want to take it that far.

Last Words
Remember that disguises are subtle, but detailed at the same time. Subtle enough not to bring attention, but detailed enough to evade familiarity to anyone who saw you prior.

Underground Physical Network

So, you find yourself on the other side of town from your home base and you just wish you had a safe house where you can freshen up before heading to your next big event. Or, what if a psycho ex-girlfriend or stalker knows every place you frequent? Wouldn’t a few hiding places work to your advantage? This is exactly what we will be discussing today! Whether it be to escape from real life for a few seconds, hours, or days at a time, I’m going to illustrate how you can build a relatively underground network of safe houses, physical caches, hideouts, or just secret meeting areas. Now, of course before we continue, I am not telling anyone to use these techniques to run from the authorities. That’s your own mess and business.
Satellite Setup
Imagine your home or place of residence as a command center or home base. All other locations are going to be referred to as satellites. The first thing to be done is to find several locations with the following criteria:
1. Trustworthy: You know the host very well and they would cover for you if needed. Hosts being the owner or manager of each particular location, i.e. friend’s house, office, etc.
2. Accessible: Availability of your satellites need to be no less than 95%. You never know when you are going to need such a facility especially since most of the time it would be used for emergency or unplanned circumstances.
3. Proximity: Near and far from your normal routine. As an example, I have spots all over the city; a few of which are on The Strip.
4. Quick or camp?: Places that are used to drop off excess baggage or can be used to camp at for a few days
Keep this guidelines in mind and you will be well on your way to establishing your underground network.
At The Satellite
Now that we have locations set up and available to us it’s time to make these areas into fully functional facilities. With proper resources, you can stay off the grid for a while and remain comfortable. First, we need to establish the necessities such as food and restrooms. If your location does not have food in it, make sure it’s relatively close to a place with some sort of food supply. Restrooms are a must unless you have an iron bladder. Next, a change of clothes would be ideal for comfort, or for a new look when leaving the facility. You can come as a business person and leave as a casual civilian or vice versa. Please refer to the Autumn 2008 edition of The Quarterly for my article on 6 points of disguise if you need ideas on wardrobe. Your material can be as simple as a backpack of clothes stashed nicely in the facility somewhere to a full blown walk in closet. After the bare necessities are are covered, we can add other features for additional functionality. If it is possible and realistic, Internet access would be great to have at your sites for several reasons that we are all aware of. Make sure your connection is proxied :-)  A few books or a small entertainment system may be in order if you are planning on staying a while. Just keep in mind that portability should be a priority when staying out of sight.
What if the Satellites are Compromised?
There may come a time when someone discovers your clandestine station. What should you do? Is there anything you can do? How exactly do you recover? It is inadvisable to revisit a compromised satellite. Someone crazy could be waiting there for you. This is why all resources at any location should be easy to replace and inexpensive. If you must visit a site after someone dangerous knows about it, get there quickly. Take what you need. Destroy what you don’t. You won’t be able to visit this particular facility for quite some time if ever again.
Preventing Satellite Compromise
Of course there are measures you can take to minimize the probability of your underground network being discovered and these steps are very simple. Make sure no one important is watching you as you access these sites. This destroys the entire purpose of being covert. Follow the “need to know basis” policy. No one really needs to know where you are to contact you. Cellphones are a wonderful thing. The hosts of your locations only need to know their specific role in your network. Only your closest loved ones should know exactly where you are. I’m referring to those who would report you missing and put your picture on the 6 o’ clock news if you went off the grid without them knowing. Only use your satellites when you need to. Frequent visits can develop a pattern that others can use later for surveillance. Physical caches may be used instead of satellites for quick drop off and pick up of sensitive material.
While Off The Grid
Invisibility is important in times like these, so here are a few things to help you. While out and about, invest in a prepaid cellphone that doesn’t require your actual information for service. Always pay in cash because it does not leave a paper trail. If you have a GPS enabled phone, disable GPS. PO Boxes (boxen?) are something you might want to utilize so no one can pin point any place of residence on you.
Conclusion
Remember that in today’s age you are responsible for your own privacy and security. This ideology transcends technology and should really be viewed as a lifestyle. Too much paranoia can make you crazy, but no paranoia can leave you completely exposed to anyone. What’s wrong with having a place to escape the real world?

In my humble opinion…

A new year has arrived, and Vidocq is hopeful that, within this new decade, justice will finally be more about the truth than about ‘closure’. As much as we need procedure to bring a case to court, procedure can also stand in the way of bringing a case to court. Fluid thinking in this area would be searching for alternative explanations of the facts.

We have seen many exonerations in the recent past where defendants were on death row for decades. I understand if you are skeptical. Where there is smoke, there is fire. Someone cannot be on death row and be innocent, right?

Wrong.

The majority of incarcerated people are guilty as charged, but there is this small minority of people who are wrongfully convicted. And I do not mean less guilty than charged. I mean wrongful as in “you’ve got the wrong person!”

There are many ways how an innocent person can end up on death row. False confessions and mistaken eyewitness identification play a huge role, as well as faulty science. I encourage you to read about this on the wonderful blog from the Innocence Project and the website from the Death Penalty Information Center.

Let’s go back to what thinking fluidly could mean for human rights cases. It should mean that despite hurdles, we can still get access to the courts, when we have strong evidence that contradicts the verdict. It would not be right to continue without identifying my new hero: Justice John Cataldo of the State Supreme Court in Manhattan. The NY Times reported in November of last year that, in the case of the People of the State of New York v Fernando Bermudez, finally a judge had the courage to pronounce these two words: “actual innocence.”

Now you may wonder why Vidocq gasped when we read those words……allow me to explain.

By acknowledging that actual innocence was at the core of this case, Judge Cataldo opened the door to get actual innocence established as a legitimate ground for a new hearing after the trial in the first instance. In 1993, we were stunned by the United States Supreme Court’s decision in Herrera v Collins. In this case, the US Supreme Court confirmed that “claims of actual innocence based on newly discovered evidence have never been held to state a ground for federal habeas relief absent an independent constitutional violation occurring in the underlying state criminal proceeding.” Chief Justice Rehnquist said that judges are not empowered to correct errors of fact even if the mistake could lead to the execution of an innocent man. Federal courts were only to intervene when state courts violated constitutional procedures.

According to Chief Justice Rehnquist, “the proper procedure for making claims of actual innocence after the judicial process has been exhausted is by filing a request for executive clemency. Clemency is the historic remedy for preventing miscarriages of justice; it has provided a fail safe in our criminal justice system.” However, there have been many cases in which clemency should have been granted but was denied. Most notably, the case of Cameron Todd Willingham comes to mind.

The Willingham case has been all over the news, so we will not discuss it in-depth. In short, on December 23, 1991, a fire broke out in one room of the Willingham home, in Texas. Willingham’s then-wife and mother of his children, was not home. Their three daughters were and lost their lives. Willingham himself was home, tried to save his children, but was forced back by the intensity of the fire. He escaped with minor burn injuries. The investigation that lead to his capital charge and conviction was based on analysis and procedures that were later discredited. Willingham denied from the beginning that he had set the fire.

At the time of Willingham’s clemency request, forensic arson analysis had made significant progress, and it was clear that numerous conclusions that were drawn at the time of the trial were incorrect. Among other things, modern forensic arson detection established mistakes centered on puddle configurations, pour patterns, burn trailer, and V-shaped burning marks. At the time of the trial, V-shaped burn marks were taken as sole indication for the point of origin of the fire. However, modern arson forensics has established that V-shaped burn marks occur repeatedly during post flashover. Flashover occurs when radiant heat causes fire in a room to be a room on fire; it can happen within minutes without liquid accelerant. The then-held beliefs about flashover were wrong. After everything in the Willingham room ignited, post flashover occurred when the blaze went from a fuel-controlled fire to a ventilation-controlled fire. As Willingham opened a door, the fire followed the path of a new source of oxygen, leaving a trail to that door. This trail was mistakenly believed to be caused by a liquid accelerant.

After numerous unsuccessful appeals, Willingham’s last hope was executive clemency by the Governor of Texas, but Chief Justice Rehnquist’s belief in clemency as an effective means to prevent miscarriages of justice turned out not to be justified. Texas Governor Perry received the Willingham defense report with the new scientific analysis, but denied clemency nevertheless. A clemency decision does not require the level of scrutiny that a trial requires. In fact, in Texas, the members of the Board of Pardons and Paroles and the Governor do not have to give any reasons for their recommendations and decision. This is exactly why the clemency process is insufficient in cases where there is proof of actual innocence. Sadly, the intense criticism following Willingham’s execution did lead Governor Perry to replace members of the Texas Forensic Science Commission. If only the Willingham defense had been granted one more hearing, the execution would not have taken place.

Back to the Bermudez case.

Judge Cataldo writes, “I find the due process clause of our State Constitution requires a procedural mechanism be provided for an incarcerated defendant to bring a post-conviction motion upon a claim of actual innocence. Under a claim of actual innocence, the hearing court may examine all of the available, credible evidence in order to determine whether the defendant has met his burden of proof. As noted in Justice Blackmun’s dissent in Herrera v. Collins, 506 US 390, 435-437(1993), to ignore a claim of actual innocence would be “fundamentally unfair” as a matter of procedural due process.”

As you can read in the NY Times article, actual innocence statutes could “give judges the leeway to excuse procedural violations, missed deadlines and other mistakes if the evidence is strong enough.” Especially when dealing with capital punishment, we are convinced that actual innocence statutes are not just necessary, they are crucial. Too many people have had to be exonerated long after their initial conviction. In most of those cases new DNA technology was a determining factor. Because of the power of DNA evidence, those cases are dealt with under separate laws. However, as the Bermudez case shows, clear and convincing evidence for actual innocence claims does not need to involve DNA. DNA evidence should not be the only possible evidence to bring capital cases back to courts for review. A series of developments in forensic science have made it possible that more cases can be reviewed. Examples of such developments are partial finger printing, new methods for arson detection (especially concerning burn patterns, flashover, and puddle configurations), and forensic odontology (bite marks). On the other hand, bullet lead analysis is now a discredited forensic tool, because it has been shown that the distribution of metal alloys in a bullet cannot be linked to when and where the bullet was made.

Many will disagree stating that ‘closure’ will be undermined, and that the endless appeal possibilities will only prolong the agony of victim family members. Vidocq understands that but respectfully disagrees. We still see justice as seeking the truth and not as bringing the case to its end in the last court. We talk about new evidence that surfaces long after the trial is over, because of new technology, earlier prosecutorial misconduct, etc. The new evidence must be so strong that it is abundantly clear, beyond any doubt, that the defendant would not have been convicted had the evidence been available at the trial. The evidence must be strong, of course, to prevent frivolous claims of actual innocence. The threshold to re-examine these cases or grant a new hearing should be high, but it should not be an insurmountable wall.
